Pennsylvania now has a law on AI in advertising. Governor Josh Shapiro approved Senate Bill 806, the Artificial Intelligence Deceptive Advertising Act, on 22 October 2026, the General Assembly’s bill page shows.

The law is about what it calls synthetic content: text, images, video or audio that AI has generated or significantly changed. When an ad uses such content to give buyers a false idea of a product’s nature, origin or authenticity, it needs a clear and conspicuous disclosure. The Verge reports that the label must take the same format as the ad and that the rule ignores where the ad was made, so a TV spot produced in another state needs it too if it airs in Pennsylvania. Plainly fictional content is exempt, as are criticism, commentary, satire and parody.

Enforcement sits with the state’s Attorney General or a district attorney, and a court can impose a civil fine of up to $3,000 plus legal costs, says the House Appropriations Committee’s fiscal note. The act takes effect 60 days after it was signed, which by our count is 21 December 2026.

Two other US laws on our AI disclosure guide, read 26 September 2026, work differently. New York has required a disclosure for a synthetic performer, an AI-made person, since 9 June 2026, and California’s SB 1050 covers synthetic figures and voices from 1 January 2027. We added Pennsylvania to the guide today.

Pennsylvania’s label turns on a false impression of a product’s nature, origin or authenticity, so an AI-altered product shot can need it there even when no AI person appears in the ad.
